  • Reverse domain hijacker gets his come up'ins..

WIPO doesn't have this on their site yet but this is a funny one (but the defending attorney does have it on his site).

The case itself was pretty generic, the complainant (Hero in Switzerland) is going against "The Heroic Sandwich" and it was successfully defended (but reverse hijacking was not ruled, only the complaint was denied).

The funniest part happened with a chat with John Berryhill (the defending attorney) in another forum that apparently, years ago, the vice president sent the owner of the domain Hero.com (from his personal email) that hew was putting together a "base-ball" team (yes, that is how he spelled it) named "Hero" and wanted to buy the domain for $250K.

This was their initial claims of the "bad faith" aspect. One problem.

The VP had no plans to put together a baseball team and was only doing this to build up a bad faith case. Guess what? That is considered wire fraud and can be punishable with a jail sentence.

Meaning, someone got greedy and went after something they didn't deserve (by only paying a $1500 court fee as opposed to what the domain is worth) and may end up in jail because of how he did it.

Apparently the complainant also claimed that the defense "took too much time in their responses" thus proving that they knew they were going to lose but were shot down by the panel since all communications and responses were done in the time frame allowed.
