  • I finally saw someone flip out...

    ...over getting carded for liquor.

    I went to the truck stop last night to drop off a trailer (our yard was full) and grab a bite to eat. I'm standing at the Subway waiting for someone to come over and take my order, and I see (well, hear) a man at the store counter throwing a hissy fit because the clerk refused to sell him beer without ID.

    "But I'm OLD!!! I'm 39 years old! Ask her!" *points to Subway girl*

    The clerk held her ground and refused to sell to him, so he wound up calling his brother or someone to buy it for him.

    Now, granted, this guy looked like he could be old enough and had a rather bushy beard. But the last boyfriend I had before I started dating my now husband was only 20 and had much more facial hair than him, making him look a lot older than 20...and I'm 30 and still look about 20 and get carded for R rated movies on occasion. It's just not always possible to accurately gauge someone's age by appearance anymore. Now if I was working at a place like that and I knew someone personally that was old enough but forgot their ID, then I'd be happy to sell. But if I don't know you, I don't care if you have 10 people saying you're old enough...how do I know I can trust them?

    I wanted to smack this guy and say, "If you're 39, then act your age and quit throwing a temper tantrum like a 2-year-old. If you're old enough to drink, you're old enough to remember your frickin' ID to prove it. It's not exactly a new law." But the Subway girl (who did, in fact, know him) said that he was mentally unstable, so I kept my mouth shut, though I did suggest police should be called because he was making me nervous personally. Someone finally came in and bought the beer for him and left.

    Second party sales are (I think) illegal...

      I think that may be only if you are intending to buy for minors, but I could be wrong.

        Buying for *minors* IS illegal, but I'm talking about something different.

        When we sell beer and/or cigs, we have to card everyone in the party, even the people who aren't buying anything. If everyone didn't produce an ID, no sale.

        If someone wants to buy something, don't have an ID and send in a friend to buy whatever it is, if we suspect that it's for the person without an ID, we still cannot sell it. That is a second party sale.

          I second that. that is what I was taught in the alcohol servers class. you ID EVERYONE in the group at the time of sale or NO SALE

            Our store has a policy that we card anyone appearing less than 40 years old. And since you can be fourty and look as young as twenty or as old as...well...earth, then we have to pretty much card everyone. That's the policy. Which is fine by me because it's my ass on the line if I sell to someone underrage or corporate sends someone undercover to see if we're following policy. Sorry, your beer is not worth my job or a huge fine.

                so what the hell would you do if I had one or more of my goddaughters with me, I am *not* leaving a 6 and an 8 year old in the car unattended while I nip in for beer if I get the urge to make beer can chicken ...

                  When I learned the regulations for my area, young children didn't count as part of a shopping group (for purposes of ID checking). I would think that's what happens in other places, but I don't know.

                    that's what i'm thinking too.

                    also in some states, it's not illegal for a parent or guardian to give their children alcohol if i'm not mistaken

                      Young children are excluded.

                      It's more for people who look to be roughly 17 or so to...whatever IDing age limit the store policy says.

                        That's the way it was at the grocery store I worked at. Made it fun on Friday nights when you'd see 3 or 4 college age kids come in, head for the beer section, pile it all in one cart, then all but one would book it out of there, while the one would come through the line. Typical conversation....

                        "I need to see all the IDs of your buddies you came in with"
                        "I came in alone"
                        "No you didn't, we saw you and have it on tape, now get out"

                          Been there. As a cashier, I had to ID plenty of people, and have had one or two freak out. Hey, the law is the law. I'm like, "Do you want to pay my fine?"

                          As an aside, I was at a casino the other day, and a security guard carded me as I was walking in. And I'm in my 30's!

                            I'm not sure about all areas, but at least in S Carolina, a second party sale (aka a strawman sale) is illegal for tobacco, beer/wine/spirits, and firearms (the firearms part being Federal, of course.) Now the posession and consumption of those products may or may not be illegal, but the sale to a minor sure as heck is.

                              If a customer had a baby or small child with them (let's just say, under....13) I wouldn't care. But considering I had friends growing up whom their parents bought ciggs for them as early as age 12-13, then no sale. Sorry.

                              You want to buy for underagers, make them wait in the car or don't take them with you. It's really not that hard. That's how I got cigarettes and alchy when I was underage. DON'T GO WITH and if you do, DON'T park right in front of the damn door where you can be seen.
