For the most part returns should be in resaleable condition.

Having worked a games store I have a lot of return stories. Due to copyright law, we CANNOT return an opened game at all and if we do, it's for store credit only. This is not a store policy it is the LAW. Yet I put up with so many fights from customers begging to me to return opened games. What part of illegal do these people not understand?
