    it may have been a lot more...graphic than what was told to us. I think I would want him to be put away for that if he tried to "pretend" butt rape me while I was in the store.

      Generally, assault is actual contact, battery is intimidation or making the motions of actions if carried through would be assault (i.e. throwing a punch at someone and stopping your swing a half inch away from their nose.)

          assault is making threats and gestures, battery is wounding or touching in an offensive manner.

          if that's how the law is in california, I'm never going there. In Nebraska you can return whatever is being done to you or whatever is an iminent threat to you. I'm not 100% sure, but I've heard in minnesota you can shoot someone dead if they take 2 steps toward you in a threatning fashion

          kudos on how you handled that, this is why I work on the phones, and even then I've retreated to a support role, and they wonder why there's "no such thing as service anymore"

            Ahem; sorry, couldn't resist. But damn, California self-defense laws suck. In Germany, you can do whatever is necessary to stop a current, ongoing, unlawful attack against you or other people - *within reason*. Knocking someone down who's pushing you or someone else would be acceptable - shooting someone for smacking you with a metal ruler would not. Plus, the law states that the attacked need not run away.

            On the other hand, "self-defense excess" is a felony here, so you gotta be careful.
            You gotta polish a memory like a stone. Chip off the parts that remind you it was just a game. Work it until it's indistinguishable from any other memory.

              While the specifics vary, this is known as the Duty to Retreat, and it's the law of the land in many states -- as opposed to Stand Your Ground statutes, which exist mainly in the Deep South. Additionally, specific city and county laws may not exactly match state laws.

              Anyone who works the front lines of customer service is likely to encounter a violent SC sooner or later, so you'd be wise to keep abreast of what laws regarding self defense apply in your locality. No SC is worth a felony conviction.

                    No, but I can't see why THAT is sexual battery while full out rape is sexual assault. Not saying the original poster is making a big deal out of nothing, because it's not nothing, just wondering what's going on in the law's mind.

                      I'd say they were making sure they had plenty to charge the moron with, so if that's the case then I approve.

                      Besides, if a chap did that to a female member of this site, we'd be quite happy to see him charged with something nice and legal.
