That really blows. However, the company may have been looking to get rid of this person already, and theft of a customer's money is a perfect excuse. We don't know how may other infractions (i.e. lateness, customer complaints ) this person already had. I'm certainly not justifying it in any way. Just offering a reason.
If it was done without any merit at all, then that person should definitely sue. But I don't think they would have done it if they had to fear repercussions.
