    heck my former downstairs neighbor had at least 10 OWIs (about 5 years back before the law change) and the only reason he FINALLY got put in jail was for vehicular homiside. He ran down a pedestrian and killed them in a stop light cross walk on a Major semi-highway out by the airport

        Poor Grape. *Hugs* I am SO sorry you had to deal with not only someone so danged dense, but dense and drunk, which is never a good combo. I'm glad you all called the cops. It was a good idea.

            Don't know about that. I'm no expert, and I'm teetotal, but the general impression I have is that those convicted run a very good chance of losing their licence upon the first offence. I know of a guy at work who lost his licence for a year, though I don't know how many previous offences he had.

              I know someone who has 2 DUIs here in the US. If she gets a 3rd, not only does she get heavily fined and lose her license again...but she'll spend time in jail. Enough time, that she'll get fired from her job.

                A woman thats a regular at my work just told me Sunday that her brother who is also a regular was getting one to two years state yesterday(monday). He got a DUI and they went back NINE years to get enough DUIs to give him time.

                He was told to have all of his affairs in order before court because he would not be going back home.

                  Good, though I think slammer time would be very appropriate for a first time offender at DUI. Being stupid and killing yourself is one thing, but endangering others is reprehensible.
                  EVE Online: 99% of the time you sit around waiting for something to happen, but that 1% of action is what hooks people like crack, you don't get interviewed by the BBC for a WoW raid.

                    Like the driver of the Jeep that hit my stopped car going around 60-70 MPH, who testified that he had a pitcher of beer and two shots of tequila and was caught in the ambulance trying to hide a bag of 'white powder'.

                    He got a grand total of...one night in jail.

                    I got a lifetime of memory and back problems that have gotten worse through the almost 21 years since this happened.

                    Just think - as far as I know, he's out there on the road...

                      Here, if he was a first offender, he would have gotten his license suspended three years, if his blood alcohol content were under 0.2% the suspension would have been conditional. He would be fined a months wages times blood alcohol percentage times ten, up to 0.2% (two months wages), above that he would be fined a months wages plus do prison time up to 40 days, his employer could be informed and he would have to attend and pay a course about alcohol and driving (about $400 and ten hours).

                      The punishment would be worse if he were a second offender. No conditional suspension, fine, longer prison time, longer suspension and a new course.
                      If it's the third offence in a year, the car is confiscated and sold (plus the rest of the list).


                      ETA this is if nothing happened, the punishment would be worse when someone was injured.
