Serious question: why are you still doing business with this guy?

He seems hell bent on ripping off somebody else's website and using your designs and help in doing so.
Because the new design would've been much, much, much different, and he sincerely seemed like he was sorry. Har. I should've known.

Currently he's telling me he can break my TOS because he "hired me through Freelancer", and therefore, didn't go through the normal TOS acceptance I have. I pointed out, no, he contacted me through my website, and asked if he could pay me through that since they had funds there. I have the logs to prove that, and on my website it states that all design projects through me hold to that policy. But noooo, I apparently was "just one of the bidders". I told him go for it, use my stuff and see what happens. I'm sure the court would love to see him claim that and then have me show screenshots of what he said.

Now he's trying to claim that since I just moved hosting, and my TOS pages (with a couple of other pages) were down while I moved the site over, it meant I broke "US Terms of Service law" and now he's not bound to it.

I swear. Why do I always get the crazy ones? Oh well, I told him to take his project and shove it, that if he wants to make a crappy looking website, that's his decision, but he'd better not drag my work into it.

        He's gone. He's officially gone.

I decided to ignore his emails all day, and eventually he went through all the stages of grief...denial, anger, bargaining, etc etc. Thirteen emails from him in under six hours. Finally he broke down, and asked permission to use one small image on the site, and sent me this huge email confirming that he would only use the tiny image, and nothing more. So, with that in hand, now he's definitely tied down tighter than Lindsay Lohan's morals. Wait, I got that metaphor wrong.... <.<

Aaaaaanywho, he actually then asked if I'd be up to making a new logo for him. I literally laughed at him and then proceeded to block his emails. I'll be monitoring his site to make sure he doesn't use any more images than that single one. Already got a nice DMCA notice saved up in my Drafts folder for in case he does. :P

Just in case you hadn't heard about it -- Google Image search now supports drag-&-drop image searches (literally, hit the image site and drag a file onto the search box), making it much easier to determine if he's ripped off one of yer images and changed the name/color palette ^_^

Man, that guy has some huge ones. It's pretty obvious that he wants people to mistake HIS site for BIG SITE, since then he'll get more business. However, that's exactly why copyright laws were made, so he has to walk this fine line where he's balancing infringement of your copyright vs. the infringement of Big Site's copyright.

In either case, he's screwed if someone finally decides to take his stupid ass to court. I hope it's Big Site. They have deeper pockets. >3

I did not know that, I've just been using TinEye, which can be a bit silly sometimes. (although it did manage to find out that someone was using my most obscure pieces of artwork I've ever done on an ecard!)
