The one time I played paintball, the face mask was the most important thing in our safety briefing. To emphasise the important, punishment for taking it off was being lined up on a wall and everyone else taking a shot at you from point blank range.

We had a similar rule with the group I used to play with regularly. Unfortunately paintball can be a somewhat expensive hobby to keep up with so we don't play anymore

Story reminds me of the wannabe Stardancer whose ponytail came undone inside his helmet... So he took it off to fix it...

Why did the wavier mean nothing? :S
Around here we're taught that you can't sign your rights away, so you can sign waivers etc to yuor hearts content, they just don't mean anything legally.

In most places in the US the rights of minors cannot be signed away. This means private skate parks and sports venues are in constant jeopardy.

Here in El Paso a big private baseball park built by some people I know was sued by a child who was struck by an errant ball. He was finally forced to sell at a loss to the city (which was immune to such suits). City ran it into the ground and sold it, also at a loss; it's not in the process of being made into apartments.

Here is the OP's story, illustrated.

oh, and in case you were wondering:

              duct tape

              staple gun

I can think of another reason why the case should have been thrown out of court right away -- The OP was a minor when the incident took place. What's important was his age when it *happened*, not the his age when the suit was *filed*...That would only apply to the part of the suit that was against Rainman, however.

Also, how come the judge didn't force the SKD to pay all of the court and other legal fees? In a (relatively) clear-cut case like that, it is often how it works...Or did SO not ask for them?

Fair bet the lawsuit was on a contingency basis- i.e. no-win no-fee. What lawyer was idiotic enough to take a case that stupid on a contingency basis... I get the feeling that SO got their money back after the case was over, but that doesn't mean the business couldn't have come close to failing due to the legal bills. It's a fairly common tactic when someone doesn't have a case; try to drag out the case long enough that the other side has to either settle on your terms or give up, due to not being able to afford any more legal fees. I'm surprised whoever SO's lawyer was failed to get the case dismissed though.

NOTE: I'm not a lawyer, so anything I say is solely my opinion.

If SO was paying employees under the table he'd have a much bigger problem if the IRS ever found out about it. He was probably trying to keep a low profile.

Unfortunatly since so much time has gone by I no longer remember most of the details. Plus I was a kid, I didn't pay as much attention as maybe I should have. SO is actually serving a prison stint last I heard. Apparently he opened fire on a shoplifter (did I ever mention SO ALWAYS walked around his store and paintball field with two loaded 9mm Berettas?) No one was hurt so its ok to laugh, lol. Yeah, SO was f**king crazy.

Been a while since I read that, but I thought what happened was that he inhaled some hair and choked to death before they could get him through the airlock.
