  • Play area woes

    We recently removed our childrens play area from the bar. It was causing way too many problems and complaints, such as noise complaints about noisey children, drunk people going in there to play and the fact that almost everything from there had been stolen.

    On the sign above the play area, there is a large set of rules and regulations about going in the play area, these include:

    1) We will not be held accountable for any injury or damaged clothing.

    2) Parents MUST supervise their children at all times. We can't do it. To do that, all the staff would have to go through a huge screening process and police checks and it just isn't work the hassel.

    And yet, the amount of customers that believe part of our job is babysitting is ridiculous.

    Lady comes up to complain.

    SC: My dining experience was ruined by rowdy children! We had to actually had to climb into the play area and seperate our children from them because you wouldn't do it!

    OK, so she's complaining about her OWN children, yes that makes sense.

    Drunk students go into the play area, and start trashing it.

    Me: OK, thats enough, get out.
    Student: We're only playing. Where's the sign saying we can't?
    Me: The sign above your head that saying "Play area is only for children under the age of ten" so if you're under the age of ten, you're drinking illegally, now get out.

    We ripped out the whole play area and put tiled flooring in its place so we can store more tables, but the sign was still there. It was so high up that no one could get to it, so we're waiting for someone to come take it down.

    Two kids walk into the large empty space and start shoving each other. Somehow, they manage to fall on top of each other and hit the newly tiled floor very hard.

    Parent comes up to complain.

    Parent: We put our children in the play area and they hurt themselves! Do you really think its safe having tiled flooring like that in a play area?
    Me: Oh, well, its a newly tiled area, we've removed the play area.
    Parent: The sign is still there! It's a play area! And our children hurt themselves! What are you going to do about it?
    Me: Well the sign does say that no one here will be held accountable for any injury caused...

    They storm off, taking their mutant offspring with them.

    Yes, because a large piece of tiled flooring, with no toys whatsoever and any form of entertainment is a play area.

    What kills me is that they managed to 'hurt' themselves in an otherwise empty room.

      OK, so she's complaining about her OWN children, yes that makes sense.
      I think she was complaining about having to actually pay attention to her kids because the others were "rowdy." That's what ruined their dinner.

          1) We will not be help accountable for any injury or damaged clothing.

          That phrase is put on all types of play areas. It is a hollow disclaimer and will mean nothing when the place is sued.

            On the contrary, it should negate any liability you could attempt to place on the establishment. That doesn't mean you couldn't sue, you just wouldn't win...

            You can technically sue for anything-merited or not.

              That is what the establishment HOPES the customer thinks if there is an accident. There actually is an incredible amount of liability on the establishment's part.

                    Unless parents sign a waiver that they understand that the establishment is not liable for any injuries or damages, that statement carries no weight whatsoever. Same thing with those "we will not be held responsible for theft or damage of personal property" disclaimers. That's a POLICY, not a LAW The law has a very different opinion, sometimes.

                      Well, I can understand if the establishment shows gross negligence such as if they actually had something in the play area and didn't take precautions to safeguard exposed screws or something like that. But in this case, where there's nothing on the "play area" that could even be remotely considered an apparatus for play, I pray to god no judge saw it as negligence on the part of the bar... It's irresponsible parenting.
