  • Smackdown on the front end!

    Awesome Shift Lead C and Cashier M got into it on Monday night (in the original version of this post, M was known as C1).

    C was timing M on her breaks...not sure why. It's common to give people a bit of leeway in case they're down in the break room (time to get across the store). M got her 15-minute break at 7:30 as she was out at 8. At 7:52, she wasn't back; I went on break just then so I didn't get to see exactly what happened other than (when I came back) C on the bench, M at the podium on her phone, and the cops in the store.

    ASM told me what happened later.

    M had been generally showing up late/taking longer breaks than she was supposed to, hence why C was timing her (she was discussing this with ASM when I clocked in). When M got back, C called her up to the office and stated in front of ASM that she was writing M up. There was some yelling which apparently could be heard on the floor, among that was C saying "I'm gonna smack you!" (knowing C, it was just talk; she's a good manager). M took offense at this and went for C yelling about how "my friend is gonna come down here and F you up!" while going for her phone; ASM was in between trying to keep them from getting at each other. That was when ASM called down to the desk and told S to call the cops.

    My understanding from that point is that M wanted to press charges for 'assault'...if that sticks, it's an automatic firing. I really like C; her other job is as a CNA which means that might also be in peril if it goes on her record. From what I heard she never touched M (who was the one who escalated things).

    can you use different letters for the people? the back and forth is a little confusing.

      I don't think the assault allegations will stick without evidence of bodily harm, eyewitness accounts, or camera footage.

      And assuming there's a camera in the office, C could be a some trouble if there's audio to go along with the video. She shouldn't have threatened to smack C1, no matter how frustrated she was.

        Threatening someone with bodily harm is assault. Actually committing the harm is battery.

          Then C may well be screwed. Sorry, but threatening bodily harm isn't something that can be swept under the rug. She let her temper get the best of her and it could cost her her job.

            I know the cameras on the floor don't have sound; not sure if the one in the outer office does (if it's on the same system it probably doesn't).

              Typically, in Massachusetts, the "alleged threat" needs to be followed by some kind of physical action (whether it connects or not) in order for the police to really do anything.

              So if C said, "I'm going to smack you" but made no movement or action toward M... Police aren't going to take the charge seriously. Otherwise they'd be up to their eyeballs in complaints about how so and so "threatened" to hit such and such.

              It sounds like M attacked C first though; and the tapes WILL show that. So M's "assault" charge is pretty much ruined while C COULD file one of her own.

                Except in some states (Oregon for one), there is no "battery". Instead it's "aggravated assault".

                  That's how it's charged, but the original definition was correct.

                  States make their own descriptions for charging crimes. If you ever watch Law & Order, you'll notice they mention D felonies and other terms you probably wouldn't hear in your state.
