    Hey all.

    Yesterday was crazy busy at the c-store. I was stocking the dairy that we received from our delivery when I saw that the line was getting backed up very quickly. People were coming into the store quicker than we can get them out. So I go to my register to help my co-worker, J, to get these customers out quicker.

    Side note: We have a Coca Cola cooler stocked with their products near the front counter. This cooler had been leaking water and we had rags by there to keep the water at bay. And no, we did not have a caution wet sign there to warn people of water that could spread water there. And please people, I do not need a lecture that we should of had a wet sign there. I've already gotten this speech from my asst. manager, store manager, and district manager.
    When I checked it when I came in at 2pm, there was not a water puddle there and made a mental note to keep checking it. I know, I know, I should of had that sign up!

    Anyways, I'm at the register helping J, when a lady and her two kids came in. Apparently, the water puddle spread out into customer walking area and the lady slipped in out. She didn't fall thank goodness. But she claimed that she twisted her ankle. I didn't see her slip but J did. I went over to ask her is she is all right and she yelled that she wasn't. J told me later, that she was wearing flip flops and she was slipping and sliding in the water. J went on checking out customers as fast as she can. I got the mop to mop up the mess and got the wet sign displayed. Too late, I know. So, the lady gets what she was getting. J was the unlucky one to checking her out. She wanted the corp number and the manager's name. I said no problem, I gave her the info and apologized profusely for what happened. Of course that didn't satisfy her. She pays for her stuff and goes outside. It was still crazy busy and I couldn't get her information to pass on to managment.

    Things calm down a bit and J, goes outside to have a smoke. The lady comes back in and she said she called her lawyer and wants to fill out an incident report. *She calls her lawyer first instead of going to Urgent Care?!?!*
    I told her that I am glad she came back in because I needed her information. So she wrote out her name, address, phone number, what happened, and what injuries she sustained. Lucky for J and I, she was not bitchy about this. The lady said she was going to see her doctor on Monday about her ankle and she then said that the right side of her back hurts. I then said for whatever it is worth to her, we humbly apologize for this, do what you got to do, and we hope you feel better. She nodded okay at me and left the store. I then unpluggend the Coca Cola cooler and will remain unplugged until it gets fixed or replaced.

    I called my manager and told him what happened and he told me to call the district manager. I was kind of worried that I would lose my job over this, and my DM said oh no way, don't worry about it. She was glad it wasn't one of her employees who got hurt.

    Okay guys, yes I know it was our fault that we didn't have the wet sign up. We knew the Coca Cola cooler was leaking, but we didn't realize it was leaking that bad! For a lady who twisted her ankle, she looked like she was walking okay when she came back into the store. I thought it was extremely fishy that she immediantly called her lawyer instead of going to her doctor to get checked out. I don't think she she should wait to see a doctor till Monday because, she could've broken her ankle today and claim she broke it at our store! I think this lady is wanting money from this. I think that all our corporation will pay for is her medical bills and that's it.
    When we mop our floors, we always put wet signs up, even when it is raining outside. That one time, we neglected to have a wet sign up, some one had to get hurt. I'm glad it wasn't a kid who gotten hurt. Oh I don't want to think about that.

    I'm kind of worried about this guys.When this lady said that she called her lawyer, I got kind of scared. Have any of you guys had a customer injury in your store because of your neglect? How was it handled? What did your people higher in the food chain do? Were you called into court to testify if it was brought into court?

    Don't stress yourself out too much over this. In my last job I had at least 3 people threaten to take legal action over various things (nothing serious) but they were bluffing. I gave each customer free products & I remained very friendly, polite & apologetic & they went away satisfied - we never heard from any lawers.

    If she does decide to go ahead with it, you are not going to be personally targeted - it wasn't your fault. Sometimes people just want a bit of attention/free stuff & they pull the "i'm calling my lawer" card to get it.

      Y'all handled it well and did what you could accordingly. What I thought was a little off was the fact that she didn't go to see a physician or to an urgent care center before going to a lawyer. Not only that, but the fact that she claimed to have twisted her ankle, but when she came in the next day, she was walking fine, but claimed that her back hurt . Hell, she came back the next day to give you guys the info for the incident report! I think she just wanted to get money out of you guys.

        If I'm not mistaken, it wouldn't make any difference if the 'Caution Wet Floor' sign was up or not. Truth be told, if someone is injured from slipping on your (company's) wet floor, the company is liable. If she is successful in getting some kind of reward, your company could probably then turn around and get compensation from the people who own and maintain the machine.

        What's sad is that she can't wait to see if she can get some money for a simple twisted ankle which didn't even seem to affect her when she returned and was walking just fine.

          It is automatic to want to apologize immediately when someone is injured in your establishment but this is what we are told to do-"Do Not apologize, but express sympathy and empathy and get information..such as injury, causes, name, address, whether they are going to visit a doctor and such" We are told NOT to apologize as then we are accepting responsibility and the customer can use that against us. I had the same thing happen about a year ago, one of my staff was mopping the lobby and water dripped on the floor by the bathrooms (the tile that is used for the bathrooms and entry hall to kitchen is like walking on ice when wet, even with skid proof resturant shoes, I still slide all over) well a little girl was going to the bathroom and stepped off the carpet and onto the tile and fell. She was scraped up and bruised pretty bad, her parents were angry because there was not a wet floor sign, but again the floor was not mopped, just had water droplets from the mop. I wanted so bad to apologize, but did not and just got their information.

            I wonder.... was it caught on a security tape at all? I think it'd be kind of handy to see the accident AND how she returned (it'd be harder to win a lawsuit if a tape shows you uninjured).

              We had a lady who tripped and fell on a "spill." She said she hurt her ankle, than the next day her back, the next day her arm. After she reported it I was the person who went to check the area, she was very specific about the location which was near a refrigerated produce display. No one could find a spill and the produce guy had no cleaned spills up.

              The lady made the whole thing up (LP reviewed the video and never saw her near produce). If someone claims to hurt an ankle but is walking fine than ther back etc I am always suspicious.

                A suggestion? Remove the wording in this post that says it's your (or your store's) fault (and if a mod could edit the other posts that quote it). You'd be surprised what kinds of stuff attorneys can dig up during a discovery (I've worked for attorneys in the past), even stuff you think they couldn't *possibly* find. Better safe than sorry.

                Just avoid anything possibly incriminating, just in case.

                But still keep us up to date, without revealing too much.

                  Recently several states in the USA have enacted laws that explicitly state that an apology can not be used as evidence of an admission of guilt.
                  They found that in many cases an apology actually discourages people from wanting to pursue legal action.
