  • Deliberately rammed by angry mother!

    This was told to me today by an associate at work that I don't get to talk-to very often; well call her Abby.

    She was leaving early to go to court.. I asked her what was wrong; she was surprised I didn’t know because apparently she’s been dealing with this since July.

    She was leaving a store when she saw a woman sit a (about)11 month old baby wearing only diaper on the hood of her car. The hood was hot and the baby started screaming, prompting the mother to start screaming at the baby to stop crying. As Abby passed she told the woman that the car was probably hot and she should work on her parenting skills. Abby continued to the car and as she got in she saw the mother grab the baby and THROW it in the backseat and jump in her car. Abby had just driven to the entrance of the parking lot when suddenly the mother’s car came full-speed out of the row of cars and rammed Abby! The mother then began gunning it, trying to push Abby out into the road. Abby’s e-brake was the only thing that stopped her. Witnesses called the police who finally arrived. Of course the woman was arrested, child taken away, and witness statements were given. All the time the mother was still threatening Abby saying her boyfriend from New York was going to take her out, etc. Oh, and the mother tried to blame the entire incident on the fact that her baby was mixed race. Side note, neither party wanted an ambulance; not even for the baby!

    A few days later Abby went to the doctor for neck pain. It turns-out she had 2-bulging disks in her neck that now causes her chronic pain and she will have to go on partial disability and will need several operations later in life (she’s 18yo). Additionally, her new car was totaled and her insurance will not cover it because it was the mother’s fault, but the mother’s insurance won’t cover it because she hit Abby deliberately. Also, Abby’s witnesses changed their minds about testifying; the police believe the mother threatened them.

    So Abby is going to court hoping for the best. The mother has previously threatened to bring-in her entire family from NY to the hearing, as well as more threats of bodily harm. Abby has plenty of statements, police reports, etc. to make her case; in a world of justice she would win by a landslide. In this world, I can only hope things go well for her.

    Sadly, Abby told me that she will never open her mouth or stand-up for anyone again.

    Can't say that I blame her.

    That psycho's just lucky she didn't try that on another psycho who'd pull out a gun and do some redecorating. Or pit-maneuver her into the path of a semi.

    Also, if there's any justice in this world, psycho mom gets the book thrown at her. It would be an absolute joke if she could intimidate Abby and her witnesses and get off scot-free

      Keep us posted. That horrible woman belongs in jail and her poor baby with a family who will love it and cherish it.

        As is popular here, I'd have to echo the statements of "Document, document, document". Plus since witness statements were already provided, can't testimonies be made based off that?

          Hold on, why won't Abby's insurance cover her? I thought the insurance normally paid out to a victim, and then recovered it from the other party (or their insurance company) when at-fault is involved.

            I know a lot of time has passed, but did the store parking lot have cameras? Without a doubt that will prove the case. Though I'm hard-pressed to see how deliberately hitting a car, plus arrest, plus multiple threats won't equal horrible mom losing in court. And here's to hoping she never gets the kid back.

            I know I'm just random text on a computer screen, but I'm glad Abby stood up for the baby and I hope she knows people out here appreciate what she did and are very sorry for the grief she's experiencing. I hope she feels much better soon.

                It depends on the state. For instance, Michigan is a no-fault state, which means that if I get in an accident my insurance covers me and the other person covers them. My insurance may go after the other person's insurance if they are fault but they can't go after me. If they are at fault, I can file a mini-tort with thier insurance where my deductible gets covered though.

                  It also depends on what kind of insurance coverage you have. If she only has liability insurance, then that means they only pay the injured (other) party should she be at fault. Most states require liability insurance, but I don't know how many, if any, require comprehensive, uninsured motorist, underinsured motorist, etc.

                        I hope the baby gets a new family that will love it and care for it as should be.

                        Having 2 babys of my own at the moment the treatment and attitude shown the innocent child upsets me the most.

                          Regarding car insurance, from what I understand, insurance companies are for accidents. This was not an accident. The woman hit Abby deliberately and I believe most car insurance companies will not cover their customers if they cause damage or injury on purpose. To get compensation, Abby would have to sue the woman who hit her, and the woman who did it would have to pay Abby herself, if Abby wins.

                          Poor Abby. I hope she, and the baby, are going to be okay. What a horrible woman that mother is.

                            No. The defense has to be able to cross examine the witness. Sucks, but that protects innocent people as well, hence our Constitutional right to confront our accusers.

                            Still documentation is always a good idea.

                              Exactly. If she had Collision or UMPD for the damage to the car and UMBI (or equivalent) or Medpay/PIP for medical on her policy, they should be paying and then attempting to recover.

                              I deal with the recovery aspect of these things. Tell Abby to check into her policy and then call her state's Insurance Commissioner if needed.
