  • I was stopped but I hit you? WTF (long)

    Grrrr. My brother is in town visiting and we decided we wanted some hummus and fresh pita. There is an excellent restaurant in the nearby town that makes it fresh everyday and it is the best I have ever had. We drove the 25+ mile there with thoughts of a yummy lunch. When I pulled into the parking lot I noticed a car ahead of me backing up. I stopped. They kept backing. I laid on my horn. They kept backing. I tried to get into reverse but it was too late. The car hit me. I hopped out to see the damage. Hmm none on her car… I looked at the bumper of my car with high hopes….. alas it is quite scraped up and partially knocked off. I looked at the lady that was driving and she in a bewildered voice asked what happened… then stammered that she was just pulling into a spot and why did I hit her? WTF! I replied to her I was stopped and blowing my horn at you and you backed into me. She said she was not. AUGH!!!!!! My brother called the police, I moved my car to the nearest parking spot and hopped out. There was a sub shop right on the corner where the accident happened and I asked the men that were sitting there; “Please tell me you saw what happened? She is trying to claim I hit her!” They stated they did see. When the officer arrived I told her my side and the other lady again stated that I hit her. I told the officer about the witnesses and she went over and talked to them (Thank God they were there). The officer then went back to the other lady and talked to her again (I don’t know what was said then). When the officer finally finished writing up the accident report she came back over and gave me my copy and then turned to the other lady and stated she was being cited for improper backing. She then claimed again that I hit her!!!! The officer pointed out that the witnesses stated otherwise but the lady still kept insisting. The officer also stated she was getting a ticket for having an expired registration. That’s when the lady said I know I was trying to get it fixed after my last tickets I went to driving classes and paid all my fines. The officer said she needed to get it taken care of. She then questioned why she would get another ticket when she had already been cited for having an out of date registration. DUH you were still driving the car with it expired! If your so old you don’t know if your car is going forward or backwards you really need to quit driving.

    We did get our hummus but have not had a chance to eat it. 

    Good thing you had witnesses. You might have been pwned without them. Damage on front end, rear end, easy to assume you're responsible for the accident.

    Glad you stood your ground.

      true,I'm her brother and I was grateful that the witnesses stuck around to tell the truth about what happened.I really think that the lady believed her own story.she defiantly should not be driving.

        Thank Heavens for witnesses! I agree, this could have gone terribly wrong.

        I will never understand why sometimes in an accident, the at-fault person will always cry "You hit ME!", even in accidents where it's totally obvious that they hit you.

        One time my brother and I were coming home from school, just got down the big hill and were headed back on the main roads, had the right of way on a long, straight road, and this stupid older broad in a huge SUV totally blew a stop sign on one of the side-streets.

        Naturally, I slammed the brakes in the middle of the intersection to try to avoid collision, and thankfully, I only bounced off of her back tire (she had attempted *poorly* to gun it across the intersection.

        The dumb bitch looked at us, realized what she'd done, and tried to take off! But instead of gunning it and taking off, she just kept driving at normal speed....and this was really stupid of me but I was so mad, I cranked that wheel and got behind her and followed her for several blocks before she finally pulled over and got out of her car and said "YOU HIT ME!" to which point I yelled at her "No you dumb bitch, you ran the stop sign and thank GOD all that happened was I bounced off of your huge tires! Besides, if I hit YOU, why did you just keep driving on trying to get away?"

        Stupid bitch couldn't answer. Because there was no damage to my car from this incident (car was already in pretty rough shape for being as old as I was and having hit lots of garbage cans and deer) I told her to just forget it, and just to be a bitch I advised her that the next time she tried to get away, she might not be so lucky.

            Good thing for those witnesses! Luckily, in most cases, the person backing-up is at-fault; unless she was trying to say that as she was driving and going into the spot you rear-ended her, which sounds about right.

                    Her insurance called tonight wanting a statement. They need to determine who was at fault before paying. According to them because it was a warning and not a ticket she got it doesn't count as her being at fault. WTH? Hopefully the witness will again back me up, again. They have his name and phone number. Only time will tell at this point.

                          Sic your insurance company on them, that's what they're there for. Sounds like her insurance company is playing the typical he said she said game to put off paying and taking blame. Don't stand for it.

                          BTW, my sister got hit by a jackass at the state fair. Sis had fully parked and was getting ready to open her door when JA side-swiped her. JA tried to blame sis, then handed over the insurance info and took off before cops could arrive. JA's insurance company stalled, stating JA claimed sis hit HER. That's right, somehow sis used the broadside of her own car to hit the front end of JA's car. WTF?? JA's insurance company continued to stall for over a month and in the meantime sis stayed in touch with local police. Guess who got pulled over later that same night for DUI? And for leaving the scene of an accident? Yeah, the insurance company finally stopped stalling at that point. Real sad it took an actual arrest for them to take responsibility.

                            I've only had to deal with insurance twice in my life.

                            The first time, I hit a parked car while backing out of a space. I turned the wheel before I was out far enough and screwed up the rear driver's side quarter panel on a light pick-up. I left a note with full info and once we connected we had the insurance companies take care of everything from there.

                            The second time, the other person ran into me doing about 30, while I was trying to start moving from a complete stop. And the guy who hit me never denied it, so when the repair shop said it would cost more to fix it than to scrap it, I got a check a few days later. And I had a rental until the shop had the chance to give their estimate (and an extra weekend because I had a road trip... State Farm was easy to work with).
