  • My first car accident. Yay. (long)

    So I was on a 4 lane road, 2 lanes going each way. I was heading south, approaching an intersection with a light. I was in the right lane, going straight, and I had the green light. Of this I am 100% sure: I HAD THE GREEN LIGHT. I get to the intersection and two cars who are coming from the opposite way turn left right in front of me, but they had enough time that i didn't have to brake. They shouldn't have turned in front of me, they should have waited, but nothing came of it. However, a third car followed those two cars and also turned left in front of me; This time, I didn't have enough time to swerve or to avoid it. I slammed on my brakes but ended up t-boning her.

    Thankfully, both me and the other driver were okay; I was just sore for a few days after. Directly after the accident happened, I went up to her and asked her if she was okay; she responded with yes, and didn't speak another word to me. She didn't ask if I was okay, didn't say anything.

    The cops were called, we both gave our statements, both cars were towed, I thought okay, that was that. It's okay, her insurance will pay for it, no one was hurt, it's okay.

    Few days later, we get the police report; she states that she had the green arrow and thus I ran a red light. This is emphatically FALSE. For this statement to be true, I would have had to see this (red) light for a while (because it's visible for quite a while), thought 'fuck it!' and decided to run it for the hell of it? Um, no.

    Unfortunately, there were witnesses at the scene, but by the time I had calmed down and stopped freaking out, I noticed that everyone had left. Brilliant. I even tried calling all the businesses around the intersection just to see if maybe some had cameras pointed there but of course no one did. Even better.

    So basically, it's my word against hers, she's lying in order to cover her ass. She even tried to put a claim into MY insurance to pay for her car and her "injuries." Remember when I asked if she was okay and she said yes? Yeah. Her insurance, of course, believes her and sends me this letter saying that "uhhh yeah you ran a red light SO WE WONT PAY KTHXBAI." My insurance, on the other hand, believes me so basically this means that we're responsible for our own cars.

    So right now, my car has $7000 worth of damage to it, it's a leased car due to be turned in at the end of this month, and I'm responsible for $500 of it for my deductible.

    First car accident in 7 years of having my license, it wasn't even my fault and now I'm on the hook because someone doesn't want to take responsibilities for their actions.

    And that's why you always get witnesses' details *before* they have a chance to wander off.

    This is also something that a dashcam would have helped to resolve. It would have caught the green light that you saw and thus shown that either the other driver was lying, or that the lights were faulty (either of which exonerates you).

      Almost as good as the guy who rear ended me and had a buddy lie over the phone for him. Even though my car had stalled and was in park as I tried to re-start it, the cop decided I was changing lanes like the douche said I was.

          It's a long shot but maybe you could check that there actually *is* a green arrow light going that direction?

          Mr. Dips had somebody turn left into him and claim she had the arrow, but that intersection doesn't even *have* an arrow in that direction. The other driver genuinely thought she saw one too. Of course she also didn't see the red car she turned right into.
          The best karma is letting a jerk bash himself senseless on the wall of your polite indifference.

          The stupid is strong with this one.

            By the time I had pulled myself together, maybe 5 minutes had passed. I thought the guy would have stayed. *shrug* I'll definitely have to remember that from now on.

            And yeah, unfortunately, there is a green arrow there. However, it's at the BEGINNING of the cycle - meaning in order for her story to make sense, my light would have been red for quite a while. Which it wasn't.

                You can try to take her to small claims court for damages, see if a judge might rule in your favor.
