yeah, that was going to be my next question. If they are both underage, who is bieng charged with rape? Both of them? It's possible for boys to be raped also, so who is the rapist here?

IIRC in most states in the US, they have "Romeo and Juliet" laws where (pre)teens within a certain age range of eachother won't get charged for statutory rape, i.e a 18 year old having sex with a 16 year old. Personally I think that since, as per the account given to us, the girl seemed to be enjoying it, my bet is that it's possible that the girl cried rape to get out of trouble. I know it sounds a bit crass, and I do hate to suggest something like that, but given the op and the age of both the kids involved, it's a possibility.

In SD the age of consent is 16. When my bestfriend's 15 year old nephew had sex with his 16 year old girlfriend the girlfriend should have been charged with statutory rape. She claimed that he got her pregnant and a year later admitted that he wasn't the father after putting him and his family through hell.

BigPete it sounds like the local PD is full of it. If both kids are under the age of consent then they should charge both with statutory rape or drop the charges completely. Charging only the boy is sexist to the extreme.

It would be considered statutory rape. Under the law, a 12-year-old is not capable of giving consent to have sex, even though the act was supposedly consensual.

I agree, call me naive, but sexual relations was the absolute last thing on my mind when I was that age.

Where the heck are these kids' parents? Who even allowed them to go on this ship alone? I hope both of these kids, rape or consent, are getting punished at home. I would be really upset if my kid did that, upset and embarrassed. That's one of those things that you could never really forgive them for. . .

I've seen the term outside this board, as well.

And I can actually agree with having it be illegal for kids that young, though I'ld probably nail both of them, not just the guy. I mean, you start that early, and (aside from having it stunt their emotional growth), the odds of one or both of them ending up facing teenage pregnancy is rather high.

You know, I didn't quite read that correctly at first, since my mind is in the gutter, then I realized what you meant. I agree that it should be illegal when you are that young but don't call it rape. Give it some other name. It shouldn't be called rape when it's just two kids who are both consenting.

By German laws, as long as both are under 18, there's no problem - no matter how old or young they are. If one partner is 18 or above, however, age of consent comes in.

Age of full consent in Germany is 16 - by that age, you can legally do whatever you want with anyone over 18. At 14 or below, it's statutory rape - sex with a minor. The kicker: at 15, it's no longer a crime that will be investigated by police, BUT the parents of the minor may report you if they so choose, and then it's back to statutory rape.

Man what is with these kids that they feel the need to have sex at 12??? I mean call me old fashioned (I'm sure you will) but if kids had more respect for the act of sex and more people were encouraging waiting until marriage, I think we'd have less of this. Now it's just "do whatever you want with whomever you want - however you want and all is well" - or at least I sometimes feel that's some people's atittudes towards it..... I wonder if their parents even punished them? But anyway I think kids these days are completely oversexed and there is too much sex on TV, in music, etc. I mean even "family shows" deal w/ issues of sex and have sexual inuendos..... sometimes some censorship or at least a "moral standard" for what kids can watch is a good thing..... I know I was curious about sex when I was 12, but I certainly didn't want to have it with anyone I knew! I just don't get it....... unless the children have been abused by older adults - and then I understand the misconception that this is "what people (of any age) do to show they like each other"..... anyway - that's my opinion on the whole matter.... I'm sure there is a variety of opinions out there.......
