  • You're banning me for not paying? I'll call the cops! (Quite long)

Yes, I know it's stealing part of repsac's post's title... Sorry repsac.

    On to the story:

We have this regular-ish 'customer', who, 2 times previously, has put fuel in her car, and not had the funds in her bank account to pay for it. The first time, we couldn't chase it up with the police. Why? The relevant form wasn't filled out by her (saying basically "I promise to pay by such-and-such time and date). The second time, it was filled out.. But she didn't pay, no matter how much chasing up the boss did. Always with the excuse "I've not got the money at the moment'.

Apparently, it happened a third time, sometime recently. This time, for either $40... Or $73. On monday night, she came in, and asked for her bankcard.. Which she'd left here as security for the amount. I had no idea whatsoever that her card had been taken... Or that she'd done it again. No note in the day-book. No word from the boss. I told her to come back in the morning, as it may be in the LOCKED office. She is ok with this. Gives me $10, and puts that much in her car. Paid cash, so all is well with that one.

I tell the boss the next morning, and he (somewhat) explains what happens.
Tells me she's banned, not to let her in the store again...

The next night, she returns.. She hadn't come in that morning, as I told her to. I let her in, and explain to her that she's banned... But that she's going to have to call the boss to talk about it with him. Which she takes exception to. Demands her card from me... Which, if we have it, is in the LOCKED office still.

    Doesn't believe it's locked. I show her.
Says that she wants us to call the boss to get her card.
    I refuse, as it's 1:30AM.
She says she'll ring the police, get them to come in, get the card... from the LOCKED office.

They'll have the key, for sure....

Man she is with tells her that she should have come by in the morning, like I'd told her to. This pisses her off, as he takes my side. Demands the card again.

    Office is still, unbelievably, locked.

Man points out that the office is locked, as I did.
Lady storms out, saying it's illegal that I can't give her the card...

Police call the store, ask what's going on, and say they're sending a car. I explain that she's banned for non-payment, etc etc... Police car turns up.

Re-explain to the police all that I've said. Both on the phone to the operator, about what happened with her not paying, being banned, and to her, about coming back in the morning.

The police tell her, as I told her, to COME BACK IN THE MORNING.

She doesn't like that they tell her this.. and yells various things at them.. none of which I hear clearly, as they are outside. They chase her off, and say if she returns, to call them.

I wonder if this is the end of the story....

There's no way this is the end of the story and you know it. You may wanna consider hanging around the store when the boss comes in tomorrow just to get an eye witness account of all the suckiness that will ensue.
The only words you said that I understood were "His", "Phone" and "Ya'll". The other 2 paragraphs worth was about as intelligible as a drunken Teletubby barkin' come on's at a Hooter's waitress.

If she's been banned, how is she allowed to come back in the morning?

I've noticed that this....approach, if you will, is rather common among SCs.

It must be nice living in a world where you truely believe rage & stupidity will somehow conform reality to your will. Has that ever worked? Was there somewhere in the world where an SC succeeded in this venture?

I bet somewhere in the world, some SC tried to pull a Push to Open door on a store somewhere so many times it broke and pulled open. At that point the clouds parted, sunlight streamed down and angels descended to praise his efforts ( Well, they were probably stunned employees, but I digress ).

Now he travels the world as a simple prophet, telling all SCs who would hear his word of how they too can overcome reality with simple blind rage or stupidity. Peferably both.

If thy will not be done, raise, raise thy voice over again until thy wishs are met! For thy door is my door, and thee too can pull to open!

          Ok, I'm done now. -.-

I've actually got two days off, so it's not likely I'll see the next chapter myself.
And I seriously doubt she'd come in. She didn't the first time I told her, despite the fact that it's the boss she needs to see.

And as for being allowed to come back in the morning... I actually told her, the second time, to call. The police told her to come in.

What I don't get is why she doesn't just cancel that card, and get a new one.
The boss has obviously decided to cut his losses so that it doesn't happen with her again.

Well even people banned by a restraining order from coming back to a boy/girlfriend's house due to Domestic Disturbance are allowed to collect their stuff...usually with police escort.

In this case the Boss has the right to ban anyone from coming into the store, but can also state that so-and-so can come in and pick up something left there and to possibly get the money owed.

Update time.... (Even if it isn't much of one...)

She's not come back in, at all, since the last time I dealt with her. Her card is still in the daybook, waiting for her to come and pick it up.

I'm guessing there are one or two things that she's doing.

                  1) She's canceled the card, and pretty much cut her losses. If this has happened, we should be able to take her to court for the amount.

Also, the $40/$70 confusion... there was no actual confusion. She actually owed us two seperate amounts... I don't know who it was that let that happen...

                  2) She's waiting, and waiting, and waiting.... and waiting, in the hopes that we somehow forget the whole thing.

Which, sadly, has kind of happened before. After the 2nd time she pulled this, she came in like a month or 2 later... I asked the boss about it, because there was no note anywhere I could find... He pretty much said... "Who's that?'

And it may well happen again.. We have a rather quick staff turnover. And any new staff wouldn't be told anything about it. I suggested to the boss that we have a board that we can put the pictures of banned people on so that people would recognise them.. but I'm not sure he's going to do anything like that.

Well, she returned... On my shift of course. And I thought my last week would be pleasant, and quiet. Silly me.

I didn't notice she was even in the store, due to a misplacing of money from the change safe of $70... Which was later found. But she came in as I was counting it, again and again, trying in vain to find it... Then I looked up. There she was. She had just been served by the guy who was about to head home, as he didn't know who she was

First thing I did was ring my SM, and ask him.. His response, while she stares at me, knowing who I'm calling... I finish the call, tell her, as I did last time, that she was banned. She starts going on about how she tried to call SM several times... I say, as I don't know, or really care, that she did (or said she did), call and such. All I say is
"Boss says you're still banned..." Which prompts her to angrily say .. lots of things that can't be repeated, alongside with, basically, what did I do wrong? Why am I banned?

... Of course, it's the fact that 3 SEPERATE TIMES, she's not been able to pay for fuel that she had already put in her car... And then not returned by the time she said she would... Once, and I may be repeating what i've said before, it took 3 MONTHS to get payment. And that was only because we had the imprint of her card.

I tell her this. She says 'It's only a crime with INTENT to commit... or something.
To me, repeating the same action, despite mega-amounts of patiences on our part, each time... That's intent. She knows she can get away with it... She does it again.

Suddenly she's found that, SHOCK!, she's being called out for her wrongdoing.
Yet we can't ban her because she never intended to not pay us for 3 months... Nope. Not at all.

She has threatened to get a solicitor and take action... She said lawyer last time.
Apparently she knows the law.. and we can't do... whatever it is we've done.

Her card is still in the diary. I didn't even want to open that can of worms...

I am so glad it's my last week. Looks like it's going to be an explosive one.

I'm sorry to hear that, for your sake.

However, I must admit to being selfish enough to want you to stick around to keep us updated.

                            I feel so conflicted.
