      Is it trespassing to be in a store after it's closed? What legal rights do you think are ... um ... "gained" ... after the store closes exactly?

      We had a guy in the store a few weeks ago who would not leave until he got what he was looking for, and worse, he insisted that we had it because he (Of course) "bought it here before."

      At this point I'm thinking "Well if you bought it here before then you should have already found it. The fact that you can't find it again after so much looking should clue you in to the fact that it's not here."

      So we basically told him to look for it online when he gets home, and that he's illegally trespassing and the police will be called if he doesn't leave. He didn't believe us, but started to leave when the Manager picked up the phone and dialed, and started speaking to what he heard to have been a cop. Dunno if it was. Either way, I declare Wizard's First Rule. "People will believe a lie because they want to believe it's true, or because they're afraid it might be true."
      SC: "Are you new or something?"
      Me: "Yes. Your planet is very backwards I hope you realize."

        Of course, you could also bribe your shoppers out of the store by offering cake. And of course, the cake would be a lie.

          I think the important bit here is that it is trespassing to remain once you are asked to leave.

          An open store is still private property but by opening the doors to the public you are effectively seen as having given everyone the right to enter. So while a private house will have people invited in individually for a store everyone is invited - unless they are told they're not.

          In the short term just speaking to someone should work. In the long term stores send out legal notices but I suspect that's just because they then have evidence the person was told they weren't welcome.

          Once the general invite has been unapplied to the individual they're trespassing if they remain in the property.

          I don't think store hours have anything much to do with it though if someone broke in that's obviously a whole other crime. You could suddenly decide to close an hour early one day or open up to everyone for a day you are normally closed - if the doors are open and it's a public place I think you'd be expected to tell people they are no longer welcome.

          That's my common sense guess and the law doesn't always make sense so if anyone knows the technical answer please let me know

            Last night I was making the 10 min-'till announcement. I come up to these guys in an alcove, using their laptops, and told them how many minutes are left.

            At 8:59 I pass by again and they were standing up but their laptops were on. I told them we are closed. They said ok and continued talking. I said, "Now". They stopped talking.


            9:02 they slowly are walking to the door. I tell them tomorrow they have to be out the door by 9. They gave me a look and one said, "YOu got an attitude!" and as he was walking out the door, he called me a bitch. Security was told anyway about them still being in the back and did nothing about it.
            Time! Time! Time is what turns kittens into cats.

            Don't teach me a lesson; all I learn is that you are an asshole.

            I wish porn had subtitles.
