  • First SC of tax season '10 (kinda long)

    Our SM did a return for one of her personal friends. Well the SC claimed 3 kids, yes all hers--this was legitimate. We received the reply back from the IRS--the return was rejected because two of the three kids were already claimed as dependents by someone else. When she called we gave her the bad news and the client took great exception to this when my CW gave her the news.

    Most SC's just vent a bit on the phone over the news, but this piece of work stormed into the office and demanded to know who claimed the kids (sidebar: that info is strictly confidential--the IRS will absolutlely not disclose it to anyone). She pulled out her phone and called someone (presumebly the father of one of the kids) and demanded the the callee return her call NOW. She then planted her backside in one of the chairs and stated her refusal to leave until she got an answer. That of course was not going to happen. She cried for a bit and screamed "Just cancel, I'm going to take it to [Green Square competitor]" I explained that to the kids in question were removed from her electronic return and retransmitted--even if we could cancel, she would get the same results as the rejection came from the IRS.

    She stormed out (without police prodding to my pleasant surprise) and hollared that she would be back Monday to give the SM a piece of her mind. The irony--if she could just wait for her refund we can submit a paper refund with all her kids (we would need to include some kind of documented evidence that the kids are, in fact, living with her--she brandished some of those papers in her visit). She wold not hear any reason.

    She is a personal acquaintence of the SM. I have no doubt that the SM smoothed things over somehow. FWIW, the TM heard this story as well and is all too happy to back me on this whole matter.

        Well, not really. If someone cares enough to pursue it, you can get nailed for tax fraud if you really aren't supposed to be claiming the kids. My mom's gone to court to testify for clients where the ex- is claiming the kids, but doesn't support them in any way.

          Guess again. If fraud is challenged (by the rightful adult with custody) the fraudulent claiment owes back taxes plus interest plus a penalty. On top of that the scammer will be barred from claiming any kids for a period of time--5 years I'm reasonably certain.

          The gal in the OP can file an amended return with the evidence that she has custody of the kids and the false claimant(s?) will be on the hook for a lot of money.
